SUMMARY:Renewable Energy related issues in the Electricity (Amendment) Bill\, 2022
DESCRIPTION:Idam Infrastructure Advisory Pvt. Ltd. (Idam Infra) and the Society for Legal & Policy Research (SOLPO Research) are organising a roundtable discussion on the potential implications of the Electricity (Amendment) Bill\, 2022 for India’s transition to renewable energy (RE).   \n\n\n\nIndia has made a commitment to develop 500 GW of non-fossil fuel-based energy capacity and to reduce its estimated emissions by 1 billion tonnes by the year 2030. In the upcoming roundtable\, we will discuss whether the proposed amendments in the Electricity (Amendment) Bill\, 2022 will help the nation achieve its stated goals of energy transition. Other discussion topics will include the integration of RE with new technologies\, as well as the challenges associated with energy storage. The discussion will also have to consider the modifications brought about vide the Energy Conservation (Amendment) Bill\, 2022\, which was approved by the Rajya Sabha on 12th December\, 2022 and gives the Central Government the power to specify a carbon trading scheme as well as a minimum share of non-fossil fuel consumption by designated consumers.

SUMMARY:SOLPO Roundtable Discussion on Electricity (Amendment) Bill\, 2022
DESCRIPTION:SOLPO research is organising a roundtable discussion on “The Electricity (Amendment) Bill\, 2022 and related matters”. \n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nRoundtable Overview \n\n\n\nThe Indian power sector faces a number of challenges\, including\, the poor financial health of distribution licensees as indicated by aggregate technical and commercial (AT&C) losses and burgeoning outstanding dues to power generators\, demand-supply mismatch in domestic coal supplies\, insufficient transmission infrastructure\, grid congestions\, issues relating to open access\, and increasing non-performing assets. Apart from the above\, the integration of renewable energy and new technology\, including challenges relating to energy storage must also be resolved. \n\n\n\nThe Ministry of Power\, Government of India introduced the Electricity (Amendment) Bill\, 2022 (hereinafter\, “the Bill”) in the Lok Sabha on 8th August\, 2022 to further amend the Electricity Act\, 2003. The stated objective of the Bill is to bring fresh reforms in the power sector to address challenges relating to contract enforcement\, payment security mechanism\, energy transition\, and the need to provide choice to consumers. While the Bill intends to strengthen the regulatory and adjudicatory mechanism in the Act and to bring administrative reforms through improved corporate governance of distribution licensees\, these are features that lean towards centralisation of power at the Union / executive level. The Bill also has to be examined in the context of the changes / amendments that are being introduced through executive actions\, such as the Electricity (Late Payment Surcharge and Related Matters) Rules\, 2022\, and the proposed Electricity (Amendment) Rules\, 2022. \n\n\n\nThe roundtable aims to bring about discussion and deliberation on the Electricity (Amendment) Bill\, 2022 and related matters amongst policymakers\, legislators\, industry-leaders\, and opinion-formers of the power sector. The roundtable will explore the following:  \n\n\n\nI. Issues pertaining to Multiple Distribution Licensees \n\n\n\nII. Appointment of Chairperson and Members of Commission \n\n\n\nIII. Power to punish for non-compliance \n\n\n\nIV. Ability to refer disputes to arbitration \n\n\n\nV. Enhanced role of the National Load Despatch Centre \n\n\n\nVI. Grid security issues \n\n\n\nVII. Centralising features of the Bill

Mr. Singh currently holds the post of Secretary of Ministry of Water Resources\, River Development and Ganga Rejuvenation\, Government of India. He also has the additional charge of CEO of the National Mission for Clean Ganga. He was earlier a Joint Secretary in the Ministry of Steel\, Additional Secretary in the Ministry of Petroleum and Natural Gas and CMD\, Oil India Limited. Mr. Singh has also served as Water Resources Principal Secretary in Odisha.  \nMr. Rajendra Singh (“Waterman of India”; Water conservationist; Chairman\, Tarun Bharat Sangh) \nPost-Graduate in Hindi literature Ayurvedic physician Mr. Rajendra Singh is an Indian water conservationist and environmentalist from Alwar district\, Rajasthan. Mr. Singh’s life work has been in building social capacity to solve local water problems through participatory action\, empowerment of women\, linking indigenous know-how with modern scientific and technical approaches and upending traditional patterns of development and resource use. He is the winner of the prestigious 2015 ‘Stockholm Water Prize’. He was conferred the 2001 ‘Ramon Magsaysay Award’ for Community Leadership as well as the 2005 ‘Jamnalal Bajaj Award’ for Application of Science and Technology for Rural Development. Mr. Singh also heads the Rashtriya Jal Biradari\, a national network of organizations working for the restoration of rivers in India. \nDr. Philippe Cullet (Professor of international & environmental law at SOAS University of London; Senior Visiting Fellow\, Centre for Policy Research\, New Delhi) \nDr Philippe Cullet has qualifications in law and development studies from Geneva University\, London (King’s College and SOAS University) and Stanford University. He is also a Senior Visiting Fellow at the Centre for Policy Research in New Delhi. His main areas of interest include environmental law\, natural resources\, human rights and the socio-economic aspects of intellectual property. He works on these at the international level and in India. Dr Cullet was the Convenor of the Sub-group on Legal Issues Related to Groundwater Management and Regulation of the Planning Commission of India that prepared the draft Model Bill for the Conservation\, Protection and Regulation of Groundwater\, 2011. In 2015-2017\, he was a member of the committee of the Government of India’s Ministry of Water Resources\, River Development & Ganga Rejuvenation drafting the Draft National Water Framework Bill\, 2016 and the Groundwater (Sustainable Management) Bill\, 2017. In 2019\, he became a member of the Group of Experts of the Government of Madhya Pradesh to prepare the Madhya Pradesh Water Strategy\, including drafting the Madhya Pradesh Right to Water (Conservation & Sustainable Use) Act\, 2019. He is currently working on septage management\, water ATMs and farmers’ rights.\n \nMr. K P Bakshi (IAS (Retd.); Former Chairman Maharashtra Water Resources Regulatory Authority) \nMr. K. P. Bakshi is a 1982 batch IAS officer. He holds B.Tech (Hons) from IIT\, Kharagpur and MBA (with distinction) from HULL University\, England. His experience spans across domains of Urban Development\, Water Regulations\, Maritime Development\, Human resource planning\, Food Security\, Surveillance & Cyber Security\, Finance & Planning etc. Mr. Bakshi has held various senior positions in the Government – as the Additional Chief Secretary in the Departments of Home\, Planning\, and General Administration; as the Principal Secretary\, Food & Civil Supplies\, C.E.O\, Maharashtra Maritime Board. He has also served as the Municipal Commissioner of cities of Amravati\, Nashik\, and Thane. He was appointed as the Chairman “Godavari River Basin Water Plan Committee”\, Chairman of the “Empowered Committee” for implementing the various recommendations of the Special Investigating Team headed by Dr. M.A. Chitale in 2013\, the “7th Pay Committee for Revision of Pay-scales of the State Government Employees of Maharashtra”. He has also served as the Member Secretary of the “the High-Level Committee on Balanced Regional Development Issues in Maharashtra” set up in 2011 under the chairmanship of Dr.Vijay Kelkar.
